1. Acceptance

These terms govern the use of the ZapiA service (the “Service”), operated by Christian Fuentes Valenzuela, Santiago, Chile, contact hola@zapia.cl. By creating an account or using the Service you accept these terms and the Privacy Policy.

2. Purpose

ZapiA provides software as a service (SaaS) to automate customer service via WhatsApp using configurable artificial intelligence agents. The Service may evolve and add or remove features.

3. Account and onboarding

To use the Service you create an account linked to a valid email or a Google account. You are responsible for keeping your credentials confidential and for all activity that happens from your account. The information you provide during onboarding (business name, description, agent settings) must be truthful.

4. Permitted use

You agree to:

  • Use the Service only with a WhatsApp number you own or are expressly authorized to operate.
  • Comply with applicable laws, including personal data protection and consumer protection regulations in Chile.
  • Not use the Service to send spam or unlawful, fraudulent, discriminatory or offensive content, or to impersonate others.
  • Not attempt to access systems, data or accounts that do not belong to you, or disassemble, decompile or bypass technical limitations of the Service.
  • Comply with WhatsApp / Meta’s terms regarding the use of your own WhatsApp account.

5. Responsibility for content and data

You are responsible for the messages your agent sends to your end customers, for the content loaded into the knowledge base and for the decisions the agent automates. ZapiA is a technical intermediary: it provides the tool and AI models, but does not guarantee that generated replies are always accurate, complete or appropriate, since they depend on your settings and on third-party models.

Regarding the personal data of your end customers that passes through the Service, ZapiA acts as data processor in accordance with our Privacy Policy. You are the controller.

6. Artificial Intelligence

The Service uses third-party AI models that may produce incorrect, biased or inappropriate replies. It is your duty to review the agent’s settings, the human handoff flows and the generated messages. We recommend enabling draft mode and/or reviewing critical conversations before fully delegating customer service.

7. Plans, prices and payments

Current plans, prices and usage limits are published at zapia / pricing and may be updated with reasonable notice. While the Service is in beta, we may offer free or promotional access, subject to change. Where billing applies, tax documents will be issued in accordance with Chilean law.

8. Availability

We make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted availability. We may carry out maintenance, updates or suspensions for operational or security reasons.

9. Intellectual property

The software, brand, design and content of the Service are the property of ZapiA or its licensors. The content you upload (knowledge, messages, settings) remains yours; you grant us a limited, non-exclusive license to host and process it for the sole purpose of providing the Service to you.

10. Suspension and termination

You may close your account at any time by writing to hola@zapia.cl. We may suspend or terminate your access if you breach these terms, if your use puts the Service or third parties at risk, or if a competent authority requires it. The clauses on liability, intellectual property and governing law survive termination.

11. Limitation of liability

To the maximum extent permitted by law, ZapiA is not liable for lost profits, lost opportunities, reputational damage, data loss attributable to your own operation or to third-party providers, or the consequences of automatic replies generated by the AI you configured. In any case, total aggregate liability is limited to the amount you actually paid to ZapiA in the 12 months preceding the event giving rise to the liability.

Nothing in these terms limits liability for willful misconduct or for anything Chilean law establishes as non-waivable.

12. Changes

We may update these terms. The current version is the one published at this URL. If the changes are material we will communicate them by email or within the application. If you keep using the Service after they take effect, you are deemed to accept them.

13. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of justice sitting in the city of Santiago, without prejudice to any mandatory consumer protection rules that may apply.
